Your privacy is very important to us. Questions regarding this notice should be directed to Barter of America by email at info@barterofamerica.com. Please allow ten (10) business days for a response.

As part of the normal operation of our services we collect and, in some cases, disclose information about you. This Privacy Notice describes the information we collect about you and what may happen to that information.

If at some point in the future there is a change to our information usage practices that affect your Personally Identifiable Information, we will notify you by email (if we have your email address) of the relevant changes. Any changes are effective after we provide you with at least ten (10) business days' notice by posting the changes on our website and sending email to clients who have selected such notification.

By accepting the Barter of America Member Agreement, you expressly consent to our use and disclosure of your personally identifiable information as set forth in this notice. This Privacy Notice is incorporated into and subject to the terms of the Barter of America Member Agreement.

Section 1

Information We Collect

As part of the member registration process we ask for your company information as well as certain personal information such as name, address, and credit card information. Based on what you provide us, we may request credit-reporting agencies to provide information about your business and personal credit history when necessary.

1.4 Behavioral and usage data

We automatically track certain information about you based upon your behavior on the Barter of America Network. We use this information to do internal research on our members' demographics, interests, and behavior. This information may include the URL that you came from, which URL you navigate to next, what browser you are using, and your IP address.

1.5 Transaction data

If you choose to buy or sell on the Barter of America Network, we collect information about your buying and selling behavior.

1.6 Correspondence

If you send us personal correspondence such as emails or letters, or if other members or third parties send us correspondence about your activities, we may collect such information into a file specific to you.

1.7 Cookies

The Barter of America website uses per-session cookies to enhance search and browse functionality. Per-session cookies are not used to record Personally Identifiable Information. If you disable cookies, certain search and browse functions may not be available.

Our Use of Your Information

We use personally identifiable information about you to improve our marketing and promotional efforts, to statistically analyze site usage, to improve our content and product offerings, and to customize Barter of America's content, layout, and services.

We use your email address, mailing address, and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Barter of America Network. You have the ability to opt out of these communications at any time.

If you choose to conduct trades on the Barter of America Network or open a credit account, we use your address and billing information to bill you and provide associated support.

We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Network, to resolve disputes, troubleshoot problems, and enforce our Member Agreement.

Section 3

Our Disclosure of Your Information

As a general practice, we do not sell or rent any personally identifiable information about you to any third party. The following describes some of the ways that your personally identifiable information may be disclosed:

Due to the existing regulatory environment, we cannot ensure that all of your private communications and personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Notice. We can disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringements, or other illegal activity.

Section 4

Your Use of Other Members' Information

In order to facilitate interaction among all Barter of America members, our service allows you to access other members' contact information. By entering into our Member Agreement, you agree that you may use such information only for:

In all cases, you must give members an opportunity to remove themselves from your database and a chance to review what information you have collected about them. You may not add a Barter of America member to your mailing list without that member's express consent.

This website contains links to other sites. Barter of America is not responsible for the privacy practices of such other sites. We encourage you to read the privacy statements of each website that collects your personally identifiable information.

Section 5

Control of Your PIN or Password

You may not disclose or share your Barter of America PIN (password) to or with any third parties. If you lose control of your PIN, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. If your PIN has been compromised for any reason, you should immediately change it.

Access to your personal account online is password-protected. We will never release your account password to any third party, unless required by law. In the event that you forget your password, you may generate an online request to have the password sent to your registered email address.

Section 6

Reviewing and Changing Your Information

Following registration, you can review and may be able to change the information you submitted during registration, including:

You must promptly update your information if it changes. In responding to a request to have your personally identifiable information removed from our databases, you should not expect that all of your information will be completely removed. In some circumstances, we will maintain your information in order to resolve disputes, troubleshoot problems, and enforce our Member Agreement.

Section 7

To the extent that you disclose your information to other parties, different rules may apply to their use or disclosure of the personal information you disclose to them.

Information is stored at a physically and electronically secure data center. Direct access to this database is restricted to authorized staff and their appointed agents. Barter of America has taken every reasonable step to ensure that your information is held securely at all times.

We may, from time to time, perform analyses — or request third parties to perform analyses on our behalf — on all or part of the transaction data held by us, including personal information, on all or some of our personal account holders and traders.

Section 8

Security

Barter of America uses industry standard efforts to safeguard the confidentiality of your personally identifiable information, such as firewalls and Secure Socket Layers (SSL/TLS). However, "perfect security" does not exist on the Internet. While we take all reasonable precautions, we cannot guarantee the absolute security of your information.

Section 9

DatasUnion & Data Monetization

Barter of America operates a sister program called DatasUnion, which allows users to voluntarily opt in to share anonymized behavioral and preference data in exchange for Barter Stores Credits.
